Wonderpuck 2024 Festival Regulations

These regulations set out the terms and conditions for public participation in the 2023 WonderPuck Street Festival.

By participating in the festival, spectators, volunteers, artists, participants, collaborators and any third parties interacting directly and indirectly with the festival accept and agree to the terms and conditions of these Regulations.

The Festival is organized by the Puppet Theatre “Puck” from Cluj-Napoca, the ESUA Association, the Lions Club, with the support of the Cluj County Council, the Cluj-Napoca City Hall and Local Council and the Administration of the National Cultural Fund, collectively referred to as “THE ORGANISER”.

 

ACCESS TO THE FESTIVAL 

By participating in the WonderPuck Street Festival event, the audience confirms that they have read, understood and accepted these Rules. 

The Rules are available on the website www.wonderpuck, at the information points at the event and at the express request of any participant. 

The following items are not allowed on the festival grounds:

  • Knives, weapons and other sharp or blunt objects; 
  • Pyrotechnic articles;
  • Flammable or explosive materials;
  • Advertising material not approved in advance by the organiser;
  • Alcoholic beverages;
  • Drugs or any other hallucinogenic substances;
  • Toxic, corrosive substances, etc. that could harm persons attending the Festival;
  • Drones;

Any type of objects that may injure other Participants;

 

Access to all Festival events is free of charge. 

Participants will assume the sole responsibility for the objects they bring into the Festival area. The organizers do not take responsibility for objects that participants, volunteers, partners and third parties bring into the festival grounds during the event. 

The Organisers reserve the right to check Participants, by survey or following suspicions identified by the Organising Team and/or the Security and Protection Team, and to confiscate any prohibited items identified. In the event of any incidents occurring because of the possession of any of the aforementioned items, the holders of such items assume sole responsibility for them.

Participants are obliged to inform the Organizers’ representatives or the security team of any situation that they have good reason to report as a danger to the safety of other participants during and on the festival grounds. 

Participants are obliged to cooperate with the Organizers’ and the representatives of the health and safety services, the competent authorities and volunteers to ensure the smooth running of the Festival, to avoid situations that could endanger the safety of participants or to remedy such situations as soon as possible. 

Participants are obliged to respect the laws in force concerning smoking in the Festival area.

Participants are obliged to respect the Conditions of Use of the areas of the Festival existing at the date of the WonderPuck Street Festival, otherwise participants may be penalized according to the provisions of Law no. 61/1991 (*republished*), for the sanctioning of acts of violation of the rules of social coexistence, public order and peace.

The organizers may investigate any action likely to violate these Regulations and issue warnings, suspend, restrict or limit the access to the festival of any participant, volunteer, partner or any other third party present on the festival premises during the festival. The organizer has the right to request the assistance of law enforcement agencies, ISU representatives or other state institutions or authorities to prevent, limit or remove incidents, circumstances affecting the smooth running of the event or potentially dangerous situations for participants, organizer, third parties and/or their property or public property.

Festival participants are obliged to refrain from any actions, statements or behaviour that may endanger the life, health, dignity or physical integrity of themselves or of other festival participants. 

It is forbidden any form of commercialization or carrying out of advertising or commercial campaigns in the perimeter of the Festival without prior written permission of the Organizers. 

It is forbidden any kind of demonstration, protest or demonstration of any kind not related to the festival and the Organisers and which the Organisers have not previously approved in writing.

 

SECURITY  

On the festival grounds, the Organiser provides security through a partner qualified and accredited to do so. During the event, participants are obliged to respect the security guards, cooperate with them and follow their instructions in case of emergency. In the event of incidents of violence or endangering the physical integrity of persons, security personnel may decide to evacuate the persons concerned from the premises where the event is taking place.

 

PHOTO/VIDEO MATERIAL

Participants understand and agree that the Organizers’, Commercial Partners, authorized suppliers of the Organizer, members of the press and other Third Parties authorized by the Organizers’ may make audio, video and photo recordings of the Festival. 

The Organizer may use photo and video footage taken by its own employees, service providers, Commercial Partners and other authorized third parties in various materials produced in connection with the Festival. 

Participants by virtue of their participation in the Festival grant the Organizer and all those authorized by the Organizer express permission to record and publish images, portrayals and actions of the Festival within the Festival grounds.

The organizers and third parties authorized by them have the unrestricted right to use, copy, publish, make public, broadcast and distribute, in particular for promoting the festival, but not only, the recordings, images and photographs taken of the participants in the festival, without having to pay the latter any remuneration for their use. 

The organizers reserve the right to record directly or through authorized third parties the festival, concerts, programme and activities, to copy, distribute, broadcast or make public in any way and by any means of data transmission or by electronic means, including for the promotion of the festival. 

Participants are not entitled, within the limits of the legal provisions, to raise financial or any other kind of claims against the Organizers’ in connection with the photo-video recordings made by the Organizers’ employees, partners and/or collaborators and their publication as provided for in these Regulations. 

Participants have the right to make photo/video/audio recordings of the festival for personal use. Participants have no right to commercialize the images/photo/video recordings of the festival without prior consent of the Organizers.

 

INTELLECTUAL PROPERTY

Participants are not allowed to reproduce the event visuals (poster/flyer/etc.), use the image or names of the partners involved (or any other names, logos or brands associated with the event), or tickets/invitations to the event for promotional or commercial purposes without the written consent of the Organizer. 

The Organizer owns all intellectual property rights to trade names, logos, e-mail addresses, domain names or URLs, signs used in correspondence, database, graphics, e-mail, business cards and other materials, signs, logos, trademarks as well as materials, texts and all information, whether registered or not, on websites/online platforms in connection with the WonderPuck Street Festival. These may not be used, transferred, assigned, modified or distributed without the written consent of the Organizer.

The Organizer owns the intellectual property rights to the photographs, videos, texts, graphics, etc. taken by its collaborators and/or employees within the framework of the WonderPuck Street Festival.

Participants who violate any of the above rules are liable to pay damages

 

SERVICES AND PRODUCTS:

During the event, Participants can enjoy food and non-alcoholic beverages offered for a fee by entities contractually agreed by the Organizer in specially arranged places located in the Union Square. The sales areas will have the following schedule of activities:

– Daily from 10 am to 9 pm, on 6 and 8 September.

The sale of food products and non-alcoholic drinks will be made on cash or bankcard basis, for which receipts will be issued.

Participants are obliged to pay for all products and services they consume and purchase during the festival in the festival area. Participants shall pay for the products and services for which payment is charged using the payment methods offered by the Organizers’ or their Commercial Partners.
